Article 1 Loyer

Le prix de la location est déterminé sur la base des tarifs appliqués par Fietsverhuur Dousberg au moment de la conclusion du contrat de location.

Article 2 Définitions

  • Bicyclette : la bicyclette qui fait l'objet du contrat de location ;
  • Locataire : la personne physique ou morale qui, en tant que locataire, conclut le contrat de location ;
  • Verhuurder: de natuurlijk persoon of rechtspersoon die als verhuurder de huurovereenkomst sluit.

Article 3 Paiement

  • Les frais de location et tous les autres montants doivent être payés avant que les articles loués ne soient emportés.
  • Per artikel geldt een waarborgsom, tenzij anders vermeld op het contract. Deze waarborgsom dient om het gehuurde weer in goede staat in te leveren aan de verhuurder. Eventuele schade of diefstal wordt naast de waarborgsom verrekend.
  • Indien de huurder door welke oorzaak dan ook geen gebruik kan maken van de fiets(en), draagt de verhuurder voor de daaruit voortvloeiende kosten en schade geen aansprakelijkheid.
  • In het geval als bedoeld in het vorige lid blijft de huurder verplicht de volledige huursom en eventuele andere in de (af-)rekening vermelde bedragen te voldoen, tenzij hij met betrekking tot de huursom aantoont dat het niet kunnen gebruiken van de fiets(en) een gevolg was van een defect dat reeds aanwezig was bij de aanvang van de huurperiode.
  • Niet vooraf betaalde reserveringen worden vanaf 11.00 uur vrijgegeven voor verdere verhuur, tenzij anders gecommuniceerd en/of afgesproken met de huurder.

Article 4 Période de location

  • La période de location est la période comprise entre les heures de début et de fin de la location, comme indiqué dans le contrat.
  • Verlenging van de huurperiode kan slechts plaatsvinden na toestemming van de verhuurder en wel tegen de (verlengings-)tarieven als bedoeld in artikel 1.
  • Tussentijdse inlevering van de fiets(en) doet de huurovereenkomst eindigen zonder dat recht op vermindering van de in het contract vermelde of wegens verlenging vermeerderde huursom bestaat.
  • De fiets(en) dient/dienen bij het adres van de verhuurder te worden opgehaald en ingeleverd uiterlijk op het in het contract vermelde tijdstip van inlevering. Het voor de deur stallen of inleveren bij de receptie van Dormio Resort Maastricht geldt niet als officieel inleveren van de gehuurde fiets(en) en accessoires.
  • Indien de oorspronkelijke of verlengde huurperiode met meer dan 15 minuten wordt overschreden doordat de fiets(en) niet op tijd op het adres van de verhuurder is/zijn ingeleverd, loopt de huur door totdat de fiets(en) door de verhuurder zijn ontvangen, tegen de tarieven als bedoeld in artikel 1.
  • Onverminderd het bepaalde in het vorige lid heeft de verhuurder in dat geval het recht om de huurovereenkomst zonder rechterlijke tussenkomst ontbonden te verklaren en de teruggave van de fiets(en) onverwijld te vorderen of deze terug te nemen, waar en bij wie de fiets(en) zich ook bevindt/bevinden. Deze bevoegdheid heeft de verhuurder ook indien de huurder enige voorwaarden van de huurovereenkomst niet naleeft.

Article 5 Utilisation/responsabilité

  • De fiets(en) mag/mogen slechts gebruikt worden overeenkomstig de normale bestemming en door de in het huurcontract genoemde berijder(s). De fiets(en) moet(en) bij het adres van de verhuurder worden ingeleverd in de staat waarin de fiets(en) werd(en) ontvangen. Vervuiling door normaal gebruik wordt door de verhuurder geaccepteerd.
  • De fiets(en) wordt/worden in uiterst goede staat aan het begin van de huurperiode overhandigd aan de huurder. Indien de huurder constateert dat iets niet in orde is, dient dit direct te worden gemeld bij de verhuurder. Aan het einde van de huurperiode kan Fietsverhuur Dousberg niet aansprakelijk worden gehouden voor eventuele gebreken/defecten die niet tijdens de huurperiode zijn gemeld.
  • De huurder zal goed voor de fiets(en) zorgen. Zo dient de huurder voorzorgsmaatregelen te treffen tegen beschadiging, verlies of diefstal. De fiets(en) dient/dienen te allen tijde goed te worden afgesloten met de door verhuurder verstrekte ring- en insteeksloten en/of extra kabelsloten. De fiets(en) dient/dienen te allen tijde te worden gestald in een daarvoor bestemde fietsenstalling of berging bij de woning, het appartement of de verblijfplaats. De fiets(en) mag/mogen nooit onafgesloten of onbewaakt worden achtergelaten.
  • Het resort is voorzien van bergingen bij nagenoeg alle woningen en appartementen. Hier dienen de fietsen te worden gestald. Het centrum van Maastricht is voorzien van een aantal bewaakte fietsenstallingen. De gratis fietsenstallingen bevinden zich op Markt 36-A, de Kesselskade en bij het centraal station Maastricht. Het stallen van de fiets(en) buiten de daarvoor bedoelde plekken kan ertoe leiden dat deze wordt/worden gestolen of door de gemeente wordt/worden opgehaald en naar het fietsdepot wordt/worden getransporteerd.
  • De fiets(en) mag/mogen in elk geval niet gebruikt worden op onverharde paden.
  • Un casque est recommandé (non obligatoire) pour les vélos électriques. La société de location n'accepte aucune responsabilité du fait que le conducteur ne porte pas un casque approprié.
  • De huurder blijft aansprakelijk voor diefstal en schade aan de gehuurde fiets(en) totdat de verhuurder de fiets(en) daadwerkelijk in ontvangst heeft genomen.
  • De elektrische (bak)fietsen zijn voorzien van een tracker. Deze wordt alleen gebruikt na diefstal i.v.m. het terughalen.

Article 6 Dommages, pertes et vols

Tijdens het tekenen van het huurcontract in de winkel wordt de huurder een Safeplan aangeboden.

Het Safeplan houdt in dat de huurder bij diefstal, verlies en schade onder de voorwaarden van het Safeplan een lager eigen risico heeft.

  • Diefstal: alleen wanneer de sleutel kan worden overhandigd.
  • Verlies: indien de fiets verloren is gegaan, dient de huurder altijd contact op te nemen met de gemeente Maastricht (afdeling fietsdepot), +31 (0)43 350 40 40. Indien de fiets zich daar bevindt, kan de huurder de fiets tegen betaling ophalen. Deze kosten vallen niet onder het Safeplan.
  • Schade: in geval van een aanrijding of valpartij, uitsluitend wanneer de fiets op de juiste manier is gebruikt.

De kosten van het Safeplan bedragen:

  • € 2,50 per gewone fiets per dag;
  • € 5,- per tandem/elektrische fiets per dag;
  • € 10,- per bakfiets per dag.

Het Safeplan dekt uitsluitend schade, verlies en diefstal van de fiets(en) onder de hiervoor genoemde voorwaarden en dekt alleen de waarde van de fiets(en). Er geldt te allen tijde een eigen risico.

  • Bij een gewone fiets bedraagt het eigen risico € 50,- per schadegeval en € 100,- bij diefstal.
  • Bij een tandem en elektrische fiets bedraagt het eigen risico € 200,- per schadegeval en € 1.000,- bij diefstal.
  • Bij een elektrische bakfiets bedraagt het eigen risico € 250,- per schadegeval en € 2.500,- bij diefstal.

Het eigen risico kan niet worden afgekocht. Het Safeplan dekt geen persoonlijke schade of letsel.

Het verlies van een sleutel en/of acculader valt niet onder het Safeplan en komt voor rekening van de huurder. De kosten voor het verkrijgen van een originele nieuwe sleutel bedragen € 25,-. De kosten voor een originele Bosch acculader bedragen € 129,-.

Indien de huurder geen gebruik maakt van het Safeplan, zijn de gehuurde fiets(en) niet gedekt voor verlies, diefstal en/of schade. De huurder is volledig aansprakelijk voor beschadigingen aan of verlies van de fiets(en) of onderdelen daarvan, alsmede van fietssleutels en kettingen/sloten. Bij diefstal of verlies wordt het volledige schadebedrag in rekening gebracht. Bij diefstal dient de huurder de sleutel te overhandigen.

Inname van de fiets(en) en/of teruggave van de waarborgsom vrijwaren de huurder niet van zijn/haar verplichtingen tot schadeloosstelling voor schade, verlies of diefstal die tijdens de huurperiode is ontstaan.

Kosten van de fietsen bij het niet afnemen van het Safeplan:

  • Stadsfiets 3 versnellingen € 875,- (Batavus Personal Bike N3)
  • Stadsfiets met 7 versnellingen € 1.099,- (Cortina Socio)
  • Sportieve stadsfiets met 7 versnellingen € 899,- (Trek District 2 EQ)
  • Sportieve stadsfiets met 9 versnellingen € 899,- (Trek Verve 2 EQ)
  • Elektrische fiets € 2.499,- (Trek District+ 1 400Wh)
  • Kindertandem € 2.499,- (Onderwaterfiets XL N7)
  • Elektrische bakfiets € 5.999,- (Urban Arrow Family 545Wh)

Article 7 Coûts pendant la période de location

  • Alle lasten en belastingen ter zake van de fiets(en) zijn voor rekening van de huurder. Evenzo zijn voor rekening van de huurder alle kosten die aan het gebruik daarvan verbonden zijn, zoals stalling en reparaties, bijvoorbeeld lekke banden, alsmede defecten en kosten die het gevolg zijn van ondeskundig gebruik.
  • Algemeen onderhoud dat niet aan de huurder te wijten is, is voor rekening van de verhuurder.

Article 8 Réservation/Annulation

  • Om het voor iedereen overzichtelijk te houden, vragen we om reserveringen via onze boekingspagina te doen. Dat kan eenvoudig via: https://dousberg.fietsreserveren.nl/
  • Annuleringen dienen schriftelijk te worden doorgegeven via info@fietsverhuurdousberg.nl, onder vermelding van het reserveringsnummer. Een annulering is pas definitief nadat de huurder van Fietsverhuur Dousberg een schriftelijke bevestiging van akkoord heeft ontvangen. Zolang deze bevestiging niet is ontvangen, kan het zijn dat het annuleringsverzoek ons niet heeft bereikt en blijft de reservering actief.
  • Het is mogelijk om de reservering tot 48 uur voor aanvang van de huurperiode kosteloos te annuleren of te wijzigen. Binnen 48 uur voor aanvang is annuleren of wijzigen niet meer mogelijk en bestaat er geen recht op restitutie.
  • Na aanvang van de huurperiode is inkorten, annuleren of (gedeeltelijke) restitutie in geen geval mogelijk.

Article 9 Données à caractère personnel

De persoonsgegevens van de huurder die worden vermeld op het contract worden door de verhuurder verwerkt in de zin van de toepasselijke privacywetgeving. Aan de hand van deze verwerking kan de verhuurder: de overeenkomst uitvoeren, optimale service verlenen, de huurder tijdig voorzien van productinformatie en gepersonaliseerde aanbiedingen doen. Tegen verwerking ten behoeve van direct mailing wordt het eventueel door de huurder bij de verhuurder aangetekende verzet gehonoreerd.

Article 1 Loyer

The rental fee is determined based on the rates applicable at Fietsverhuur Dousberg at the time the rental agreement is entered into.

Article 2 Definitions

  • Bicycle: the bicycle that is the subject of the rental agreement;
  • Renter: the natural person or legal entity who enters into the rental agreement as the renter;
  • Rental company: the natural person or legal entity who enters into the rental agreement as the rental company.

Article 3 Paiement

  • The rental fee and all other amounts must be paid before the rented items are taken into use.
  • A deposit applies per item, unless otherwise stated in the rental agreement. The deposit serves to ensure that the rented item is returned to the rental company in good condition. Any damage or theft will be charged in addition to the deposit.
  • If the renter is unable to use the bicycle(s) for any reason whatsoever, the rental company shall not be liable for any resulting costs or damages.
  • In the situation referred to in the previous paragraph, the renter remains obliged to pay the full rental fee and any other amounts stated on the invoice, unless the renter can demonstrate that the bicycle(s) could not be used due to a defect that was already present at the start of the rental period.
  • Reservations that have not been paid in advance will be released for further rental from 11:00 a.m., unless otherwise communicated and/or agreed with the renter.

Article 4 Rental Period

  • The rental period is the period between the start and return times stated in the rental agreement.
  • The rental period may only be extended with the permission of the rental company and at the applicable extension rates referred to in Article 1.
  • Returning the bicycle(s) before the end of the agreed rental period does not entitle the renter to a reduction of the rental fee stated in the agreement or any additional rental fee resulting from an extension.
  • The bicycle(s) must be collected from and returned to the rental company’s address no later than the return time stated in the rental agreement. Leaving the bicycle(s) outside the premises or returning them to the reception of Dormio Resort Maastricht does not constitute an official return of the rented bicycle(s) and accessories.
  • If the original or extended rental period is exceeded by more than 15 minutes because the bicycle(s) have not been returned to the rental company’s address on time, the rental period will continue until the bicycle(s) have been received by the rental company, at the rates referred to in Article 1.
  • Without prejudice to the previous paragraph, the rental company has the right to terminate the rental agreement without judicial intervention and to demand the immediate return of the bicycle(s), or to take back the bicycle(s), wherever and with whoever the bicycle(s) may be. The rental company also has this right if the renter fails to comply with any of the conditions of the rental agreement.

Article 5 Use / Liability

  • The bicycle(s) may only be used for their normal intended purpose and by the rider(s) stated in the rental agreement. The bicycle(s) must be returned to the rental company’s address in the same condition as when received. Dirt resulting from normal use is accepted by the rental company.
  • The bicycle(s) are handed over to the renter in excellent condition at the start of the rental period. If the renter notices that anything is not in order, this must be reported to the rental company immediately. At the end of the rental period, Fietsverhuur Dousberg cannot be held liable for any defects or damage that were not reported during the rental period.
  • The renter must take good care of the bicycle(s). The renter must take appropriate precautions to prevent damage, loss or theft. The bicycle(s) must always be properly locked using the ring locks, plug-in locks and/or additional cable locks provided by the rental company. The bicycle(s) must always be stored in a designated bicycle storage facility or storage area at the house, apartment or accommodation. The bicycle(s) must never be left unlocked or unattended.
  • The resort has storage facilities at almost all houses and apartments. The bicycles must be stored there. The centre of Maastricht has several guarded bicycle parking facilities. Free bicycle parking facilities are located at Markt 36-A, Kesselskade and Maastricht Central Station. Parking the bicycle(s) outside the designated areas may result in the bicycle(s) being stolen or collected by the municipality and transported to the municipal bicycle depot.
  • The bicycle(s) may not be used on unpaved paths.
  • A helmet is recommended when using an electric bicycle, but is not mandatory. The rental company accepts no liability resulting from the rider not wearing a suitable helmet.
  • The renter remains liable for theft and damage to the rented bicycle(s) until the rental company has actually received the bicycle(s).
  • The electric bicycle(s) and cargo bicycle(s) are equipped with a tracker. This tracker is only used in the event of theft to assist in recovering the bicycle.

Article 6 Damage, Loss and Theft

When signing the rental agreement in the shop, the renter is offered a Safeplan.

The Safeplan provides the renter with a lower excess in the event of theft, loss or damage, subject to the conditions of the Safeplan.

  • Theft: only if the key can be handed over.
  • Loss: if the bicycle has been lost, the renter must always contact the municipality of Maastricht (bicycle depot department) at +31 (0)43 350 40 40. If the bicycle is located there, the renter may collect it upon payment of the applicable fee. These costs are not covered by the Safeplan.
  • Damage: in the event of a collision or fall, only if the bicycle has been used correctly.

The cost of the Safeplan is:

  • € 2.50 per regular bicycle per day;
  • € 5,- per tandem/electric bicycle per day;
  • € 10,- per cargo bicycle per day.

The Safeplan only covers damage, loss and theft of the bicycle(s) subject to the conditions stated above and only covers the value of the bicycle(s). An excess always applies.

  • For a regular bicycle, the excess is €50 per damage claim and €100 in the event of theft.
  • For a tandem and electric bicycle, the excess is €200 per damage claim and €1,000 in the event of theft.
  • For an electric cargo bicycle, the excess is €250 per damage claim and €2,500 in the event of theft.

The excess cannot be waived. The Safeplan does not cover personal damage or injury.

The loss of a key and/or battery charger is not covered by the Safeplan and is payable by the renter. The cost of obtaining an original replacement key is €25. The cost of an original Bosch battery charger is €129.

If the renter does not take the Safeplan, the rented bicycle(s) are not covered for loss, theft and/or damage. The renter is fully liable for any damage to or loss of the bicycle(s) or parts thereof, as well as bicycle keys and chains/locks. In the event of theft or loss, the full amount of the damage will be charged. In the event of theft, the renter must hand over the key.

Taking back the bicycle(s) and/or refunding the deposit does not release the renter from their obligation to compensate for any damage, loss or theft that occurred during the rental period.

Costs of the bicycles if the Safeplan is not taken:

  • City bicycle, 3-speed €875 (Batavus Personal Bike N3)
  • City bicycle, 7-speed €1,099 (Cortina Socio)
  • Sport city bicycle, 7-speed €899 (Trek District 2 EQ)
  • Sport city bicycle, 9-speed €899 (Trek Verve 2 EQ)
  • Electric bicycle €2,499 (Trek District+ 1 400Wh)
  • Child tandem €2,499 (Onderwaterfiets XL N7)
  • Electric cargo bicycle €5,999 (Urban Arrow Family 545Wh)

Article 7 Costs During the Rental Period

  • All charges and taxes relating to the bicycle(s) are payable by the renter. Likewise, all costs associated with the use of the bicycle(s), such as storage and repairs, including punctures, as well as defects and costs resulting from improper use, are payable by the renter.
  • Normal maintenance that is not attributable to the renter is the responsibility of the rental company.

Article 8 Reservations / Cancellation

  • To keep things clear and convenient for everyone, we ask that reservations are made through our booking page. You can easily do this via: https://dousberg.fietsreserveren.nl/
  • Cancellations must be submitted in writing by email to info@fietsverhuurdousberg.nl, stating the reservation number. A cancellation is only final once the renter has received written confirmation of acceptance from Fietsverhuur Dousberg. Until this confirmation has been received, the cancellation request may not have reached us and the reservation remains active.
  • The reservation can be cancelled or modified free of charge up to 48 hours before the start of the rental period. Within 48 hours before the start of the rental period, cancellation or modification is no longer possible and the renter is not entitled to a refund.
  • After the start of the rental period, shortening, cancellation or a partial refund is not possible under any circumstances.

Article 9 Personal Data

The personal data of the renter stated in the rental agreement are processed by the rental company in accordance with applicable privacy legislation. This processing enables the rental company to execute the agreement, provide optimal service, provide the renter with product information and make personalised offers. Any objection made by the renter to the processing of their personal data for direct marketing purposes will be respected.
